AGREEMENT, WAIVER AND RELEASE FORM

 

Agreement:

The Rainbow Center, Inc. of New York and Durebang of Korea will jointly host the ¡°HanMi Young Adult Korea Culture Exposure 2008!!¡± visit to Korea, August 9 – 19, 2008. As a condition to participate in the aforementioned event, the participant and parent/guardian (if under 18 years of age) shall agree to the following:

1.      I understand participation in this trip is limited to Amerasians, whose immediate birth parent, grandparent or great-grandparent is of Korean descent as indicated in the application and that I meet such criteria.  Furthermore, that I am between 16 – 30 years old.

2.      I understand that I must adhere to the rules and regulations set by the event organizers including staff, volunteers and all leadership associated with the trip. I must be respectful to others on this trip and that I will abide by the directions and guidance given to me by them.

3.      I understand that I must purchase and pay airfare and related expenses in getting to and from my departure city to South Korea¡¯s Incheon Airport to arrive by Saturday, August 9, 2008 and will participate agreeably in all activities and tours organized for the entire duration until it ends on Tuesday, August 19, 2008 as well as evaluations and any possible follow-up that might be needed after the trip.

4.      Should I select to visit relatives or friends in Korea before or after the organized trip that I may do so at my own cost and will make my own arrangements including, but not limited to transportation to/from airport/meeting location(s).

5.      I understand that should there be a ¡°Temple Stay¡±, that it is not a religious program but a cultural one that may involve an overnight stay. I further agree to participate fully in the programs of during the ¡°Temple Stay¡± which is mainly a Seon (Zen) meditation and tea ceremony.

6.      I understand that should I be asked, I will submit an essay or articles during or upon completion of the trip.  Furthermore, I understand and consent that such essay(s), article(s) may be published and/or shared in various forms of media, including but not limited to the internet and waive any compensation, financial or otherwise due me.

7.      I understand that expenses related to group meals, lodging, activities and tours will be covered by the organizers, however, should I choose to purchase souvenirs or other items for personal use/reasons, that I will be responsible for such out-of-pocket expenses.

8.      I understand the organizers will be enlisting the group in a limited travel insurance policy which covers the period upon arrival at Incheon Airport on Saturday, August 9, 2008 through departure at Incheon Airport on Tuesday, August 19, 2008 and that it would be in my interest to obtain or already have other travel or medical insurance coverage that best suits my needs.

9.      DANGEROUS OR ILLEGAL ACTIVITIES:  I understand that I will not participate in any dangerous or illegal activities. Any participant who participates in any illegal, dangerous, hazardous or detrimental activity forfeits his or her continued participation and, at the sole discretion of program organizer(s), may either be turned over to the local law enforcement agency having jurisdiction or, returned to the city of departure via the most convenient method of transportation available (and agree to reimburse the organizers for any and all costs related to such departure). The participant (or parent/guardian) hereby indemnify and hold organizers harmless from any and all costs expended (including legal fees) with respect to the subject matter of this paragraph.

Each of these three sections must be read & initialed, and the bottom signed & dated to be valid¡¦

Liability Waiver: I understand that participation in this trip is voluntary and I maybe a victim of an accident en route to and from or during that may result in serious injury or even death. I (or parent/guardian in case of minor) have made an informed decision to participate, and agree to waive, forego, dismiss any and all claims of responsibility against the Rainbow Center, Inc. of N.Y., Durebang of Korea and all facilities visited as well as all staff, board, volunteers and people associated with this trip. Furthermore and specifically, I agree that¡¦

-        The Rainbow Center, Durebang, facilities visited or places where I lodge are not to be held liable or responsible for any accidents or loss of personal property due to fire, theft or any other reason whatsoever, or the occurrence of any other unfortunate events that may transpire during my visit, and the applicant/participant (or parent/guardian) waives the right to any such claims.

-        The Rainbow Center, Durebang, facilities visited or places where I lodge are not to be held liable or responsible for any accident or illness that may occur from food/beverage preparation and/or consumption while not under the supervision of the trip organizers.
